These Terms of Use (“Terms”, “Agreement”) govern the use of the website https://nikitaynatalia.com/ (“Website”) and all services, digital content, and functionalities provided through it by ONdance sp. z o.o., ul. Borowa 20, 05-502 Kamionka, Poland, entered into the National Court Register under KRS no. 0000871948, NIP 1231481709, REGON 387656692 (“Administrator”, “Company”, “we”, “our”, “us”).

By accessing or using this Website, creating an Account, or purchasing digital content, you (“User”, “you”) agree to be legally bound by these Terms.


1. Definitions

For the purposes of this Agreement:

  1. Administrator / Company – ONdance sp. z o.o., the owner and operator of the Website.

  2. Websitehttps://nikitaynatalia.com/ and all its subpages.

  3. User – any natural person using the Website, including Consumers.

  4. Services – all electronic services provided through the Website.

  5. Digital Content / Courses – online educational materials, video recordings, and other intangible digital content delivered electronically.

  6. Access to Courses – paid license-based access to Digital Content through an Account.

  7. Account – an individual User profile enabling the use of purchased Services.

  8. Newsletter – a free email subscription service.


2. Scope and Nature of Services

Through the Website, the Company provides:

  • access to free publicly available content,

  • paid access to Digital Courses,

  • electronic Account services,

  • Newsletter subscription.

Digital Content is supplied exclusively in electronic form, without any physical medium.


3. Technical Requirements

To use the Website and Digital Content, the User must have:

  • a device with internet access,

  • one of the latest versions of common browsers (Chrome, Firefox, Safari, Edge),

  • JavaScript and cookies enabled,

  • an active email address,

  • sufficient bandwidth to stream video content.

The Company is not responsible for technical issues resulting from the User’s hardware, software, or internet connection.


4. Conclusion of Agreement and Payments

  1. To obtain Access to Courses, the User must:
    a) create or log into an Account,
    b) select desired Digital Content,
    c) complete payment through available processors (e.g., Stripe),
    d) accept these Terms.

  2. Access is granted after payment confirmation.

  3. Payment service providers may perform independent verification steps. Their terms apply in addition to these Terms.

  4. All prices on the Website include applicable taxes unless stated otherwise.

  5. Users must provide correct and truthful data; the Company is not liable for any damages caused by incorrect data provided by the User.


5. License to Use Digital Content

  1. The Company grants the User a personal, limited, non-exclusive, non-transferable, non-sublicensable license to use Digital Content solely for private, non-commercial purposes.

  2. The User is strictly prohibited from:

    • sharing access to Digital Content or their Account,

    • copying, downloading, recording, screen-recording, redistributing, selling, or publicly displaying content,

    • creating derivative works based on the Digital Content,

    • removing or altering copyright notices.

  3. Any violation constitutes an infringement of intellectual property rights and may result in civil and criminal liability.


6. No Right to Withdrawal & No Refund Policy

6.1. No statutory right of withdrawal

According to Article 38(13) of the Polish Consumer Rights Act and EU Directive (EU) 2011/83, the User has no right to withdraw from a contract for digital content not supplied on a physical medium, if:

  1. the User expressly consented to immediate access,

  2. the User acknowledged and accepted loss of the statutory withdrawal right,

  3. access began before the 14-day withdrawal period expired.

By purchasing Digital Content on the Website, the User expressly agrees to immediate delivery and permanently waives the statutory withdrawal right.

6.2. No refunds – final and binding purchases

Due to the nature of Digital Content:

  • once access is granted, the service is fully performed,

  • Digital Content cannot be “returned”,

  • the User obtains full benefit immediately after payment.

For these reasons, all payments are final and non-refundable, regardless of:

  • lack of use;

  • change of mind;

  • dissatisfaction with the User’s device or internet connection;

  • scheduling conflicts or lack of time;

  • personal circumstances after purchase.

This is a necessary and lawful protection of the Company’s intellectual property and digital product access system.


7. User Account

  1. Users may request Account deletion by emailing nikitaynatalia@gmail.com.

  2. Deleting an Account results in permanent loss of access to purchased Digital Content.

  3. The Company may suspend or terminate an Account in cases of breach of these Terms or applicable law.


8. User Obligations

The User agrees to:

  • comply with applicable law and these Terms,

  • refrain from sharing login data or Digital Content with third parties,

  • refrain from actions that may hinder or disrupt the Website,

  • provide accurate data during registration and purchase,

  • refrain from uploading illegal or harmful content.

The User is liable for damages caused by violations of this section.


9. Administrator’s Liability and Risk Management

  1. The Company is not liable for disruptions caused by:

    • force majeure,

    • service providers (hosting, payment processors),

    • technical failures on the User’s side,

    • maintenance or upgrades.

  2. Although the Company strives to ensure high availability, uninterrupted access cannot be guaranteed.

  3. The Company is not liable for indirect damages, consequential loss, loss of profit, or data loss not caused by its intentional actions.

  4. The Company may temporarily suspend the Website for maintenance, updates, or security reasons.


10. Complaints

  1. Complaints may be submitted to nikitaynatalia@gmail.com
    (subject: “Complaint”).

  2. A complaint must include:

    • User name,

    • email address,

    • a detailed description of the issue,

    • proposed resolution.

  3. Complaints are processed within 30 days.

  4. This procedure does not exclude statutory consumer rights.


11. Personal Data Protection (GDPR / RODO)

  1. The Administrator is the controller of personal data processed through the Website, in accordance with Article 4(7) GDPR.

  2. Personal data is processed under:

    • Art. 6(1)(b) GDPR – contract performance,

    • Art. 6(1)(c) GDPR – legal obligations (tax, accounting),

    • Art. 6(1)(a) GDPR – consent (Newsletter),

    • Art. 6(1)(f) GDPR – legitimate interest (security, fraud prevention).

  3. Categories of processed data:

    • identification data (email, name),

    • payment data (processed exclusively by Stripe),

    • technical data (IP, logs),

    • Website usage data.

  4. Personal data may be shared with:

    • hosting providers,

    • payment processors (Stripe),

    • email and newsletter systems,

    • analytics tools.

  5. Transfers outside the EEA (e.g., to Stripe in the US) are subject to:

    • Standard Contractual Clauses (SCC),

    • appropriate GDPR safeguards.

  6. Users have GDPR rights to access, rectify, erase, limit processing, object, and request portability.

  7. Details are outlined in the Privacy Policy, available on the Website.


12. Amendments to the Terms

The Company may amend these Terms due to:

  • changes in law,

  • decisions of authorities,

  • expansion or modification of Services,

  • technical or security reasons.

Users will be notified of material changes by email or Website notice.


13. Governing Law and Dispute Resolution

  1. These Terms shall be governed by Polish law.

  2. Consumers may use out-of-court dispute resolution mechanisms (Consumer Ombudsman, Trade Inspection, ODR platform).

  3. Non-consumer Users agree to resolve any disputes before the competent court for the Company’s registered office.
